Terms of Service | HD Image Enhancer

These Terms of Service ("Terms") are an agreement between you and HD Image Enhancer ("we", "us") and govern your access to and use of https://hdimageenhancer.com and the AI image enhancement tools offered on it (the "Service").

By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

The Service

The Service lets you upload images and uses artificial intelligence to sharpen, deblur and upscale them. We may add, change or remove features at any time, and we do not guarantee that any particular feature, output resolution or processing speed will always be available.

Eligibility

You must be at least 13 years old (or 16 in the EEA and UK) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms for it.

Free credits and usage limits

Each browser receives 20 free credits per day, and each enhancement costs 4 credits. A shared daily limit of 60 credits also applies per network.
Credits reset every day at 00:00 UTC. Unused credits do not roll over.
Credits have no cash value and cannot be sold, transferred or exchanged for money.
Credits used on a job that fails for technical reasons are returned automatically.
We may change the number of free credits, the cost of an enhancement, rate limits and other usage limits at any time.
You may not bypass or manipulate usage limits, for example by clearing cookies, rotating IP addresses, using multiple browsers or devices, or automating requests.

If we offer paid plans or additional features in the future, they may be subject to additional terms presented at the time of purchase, which will form part of these Terms.

Your content

You keep all ownership rights you have in the images you upload ("Input") and, to the extent permitted by law, in the enhanced images generated for you ("Output"). To the extent we have any rights in Output, we assign them to you.

You grant us a worldwide, non-exclusive, royalty-free license to store, copy, process and transmit your Input and Output only as necessary to operate and provide the Service to you, including through our service providers. This license ends when the files are deleted, which happens automatically within 24 hours of upload as described in our Privacy Policy, so download any Output you want to keep. We do not use your Input or Output to train AI models.

You confirm that you own or have all necessary rights and permissions to upload your Input and to have it enhanced, including consent from any identifiable person shown in it where required by law.

Acceptable use

You agree not to use the Service to:

Upload, create or share content that is illegal, or that sexualizes, exploits or endangers minors in any way.
Process intimate or sexual images of a person without their consent.
Infringe or misappropriate anyone's intellectual property, privacy or publicity rights.
Create deceptive content intended to defraud, defame, harass or impersonate others, or to fabricate evidence.
Upload malware or files designed to harm or exploit the Service or its users.
Access the Service through bots, scrapers or other automated means, or resell or provide the Service to third parties without our written permission.
Interfere with, overload or disrupt the Service, or probe, scan or test its vulnerability without authorization.
Reverse engineer, decompile or attempt to extract the source code or models behind the Service, except where the law expressly permits it.
Violate any applicable law or regulation.

We may remove content, block requests and report illegal content, including child sexual abuse material, to the appropriate authorities.

AI-generated output

Enhancement is performed by AI models that reconstruct detail. Output may be inaccurate, may add or change details that were not in the original, and may differ each time you process the same image. Output is not a faithful record of reality and must not be relied on for forensic, legal, medical, identification or evidentiary purposes. You are responsible for reviewing Output and for how you use it.

Our intellectual property

The Service, including its software, design, text, graphics, logos and the HD Image Enhancer name, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you. If you send us feedback or suggestions, we may use them without any obligation to you.

Third-party services

The Service relies on third-party providers for hosting, storage, AI processing and analytics, and may contain links to third-party websites. We are not responsible for third-party services or content, and your use of them may be subject to their own terms.

Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT OUTPUT WILL MEET YOUR EXPECTATIONS. PLEASE KEEP YOUR OWN COPY OF ANY IMAGE YOU UPLOAD, AS WE DO NOT PROVIDE LONG-TERM STORAGE AND ALL FILES ARE DELETED WITHIN 24 HOURS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 50.

Some jurisdictions do not allow certain warranty exclusions or limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits any rights you have as a consumer that cannot be limited by contract.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your Input, your use of Output, or your violation of these Terms or of any law or third-party right.

Suspension and termination

You may stop using the Service at any time. We may suspend or restrict your access, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure for us, or if we discontinue the Service. Provisions that by their nature should survive termination, including those on your content, AI-generated output, intellectual property, disclaimers, limitation of liability, indemnification and general terms, will survive.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page, and for material changes we will provide a more prominent notice. Your continued use of the Service after the changes take effect means you accept the updated Terms.

General

These Terms are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
